This website, https://www.arcforgesupply.com (the “Site”), is operated by Serion Commerce Group LLC, a Kansas limited liability company, doing business as Arc Forge Supply Company (“Arc Forge,” “we,” “us,” or “our”).
By accessing or using the Site, including purchasing products, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access the Site or use our services.
1. ELIGIBILITY & USE
You represent that you are at least the age of majority in your jurisdiction and that you are legally capable of entering into binding contracts. You agree not to use our products or services for unlawful purposes or in violation of any applicable laws.
2. PRODUCTS & FULFILLMENT
Arc Forge Supply Company sells welding equipment, metal fabrication tools, consumables, safety gear, and related industrial supplies.
Some products are fulfilled directly by third-party manufacturers or distributors. Orders may ship in multiple packages and from different locations.
3. PRICING & ORDER ACCEPTANCE
All prices are subject to change without notice. We reserve the right to refuse or cancel any order at our sole discretion, including suspected fraud, reseller abuse, or pricing errors.
Order confirmation does not constitute acceptance. A contract is formed only when the order is shipped.
4. SHIPPING & RISK OF LOSS
Shipping timelines are estimates only and not guaranteed.
Risk of loss and title pass to the customer once the order is tendered to the shipping carrier, regardless of shipping method. Arc Forge is not responsible for carrier delays, loss, or theft after shipment.
Freight or oversized items may be delivered curbside only and may require customer assistance for unloading.
5. RETURNS & REFUNDS
All returns, refunds, and exchanges are governed by our Returns Policy, which is incorporated into these Terms by reference.
6. WARRANTY DISCLAIMER
Products are provided “as is” and “as available,” unless otherwise expressly stated. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.
Industrial tools and welding equipment must be used by trained professionals. Improper use voids any warranty.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Serion Commerce Group LLC’s total liability shall not exceed the amount paid for the product giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages.
8. INDEMNIFICATION
You agree to indemnify and hold harmless Serion Commerce Group LLC from any claims arising from misuse of products, violation of law, or breach of these Terms.
9. INTELLECTUAL PROPERTY
All content on the Site is the property of Serion Commerce Group LLC or its licensors and may not be used without written permission.
10. DISPUTE RESOLUTION & ARBITRATION
Any dispute arising out of or relating to these Terms or any purchase shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Arbitration shall take place in Kansas. Class actions are waived. We may seek injunctive relief for intellectual property violations.
11. GOVERNING LAW
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.
12. CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Site constitutes acceptance of any changes.
